PAYMENT OF PRE PAYMENT OR FULL PAYMENT CONSTITUTES ACCEPTANCE OF THESE TERMS AND CONDITIONS

The terms and conditions of booking are subject to change without notice.

Please read these terms and conditions carefully. When you make a booking, you accept on behalf of your party the terms of these booking conditions. 

It is your responsibility to ensure that all the details on your confirmation documents are correct and to bring to our attention any errors or discrepancies within 48 hours of your booking.

By making a booking for accommodation, guests warrant they have read these terms and conditions and agree to be bound by them subject to such changes as are notified to them.

 

Booking Conditions, Rates and Payments

All rates quoted are in Australian Dollars (AUD) and include GST.

A booking confirmation must be obtained. If a booking confirmation is not obtained, the booking is not confirmed.

It is the responsibility of the guest to review the booking confirmation and promptly advise Beach Houses of Byron if there are any errors or misunderstandings.

To make a booking, a non-refundable pre payment of 10% of the booking balance must be paid to Beach Houses of Byron. The balance is payable 14 days prior to arrival.

A pre payment of 50% is required during Peak and Peak+ times (December, Jan, Splendour, Xmas, New Years, Easter), and the balance is due 30 days prior to arrival. 

To make a booking at Cove Studios or Cove Quarters, 50% of the booking balance must be paid to Beach Houses of Byron and the balance is due 30 days prior to arrival. 

The pre payment must be received within 24 hours. If a pre payment is not received by this time, we will assume you no longer require the reservation, and it will be cancelled.

A 1.65% surcharge applies for all Visa and Mastercard transactions. We do not accept AMEX. 

Non-payment within these terms may forfeit your booking.

Beach Houses Of Byron Bay Pty Ltd engages a limited payment collection agent to provide payment to our hosts. This means that upon payment of the total price to Beach Houses Of Byron your payment obligation to the host of the property you have booked is satisfied. 

 

Accommodation

All accommodation is subject to availability.

Beach Houses of Byron will endeavour to provide the accommodation but reserves the right to refuse requests for bookings or actual bookings.

 

Arrival and Departure

Check in is from 3pm.

Check out is by 10am. At this time, you must check out of the house and return the single key to the key box. A replacement fee will apply should the key(s) be missing.

Rubbish is to be removed and placed in garbage bins located at the side of the house. Pick up all cigarette butts, bottle tops from the house, decks, and gardens.

All furniture is to be placed back in its original position.

The kitchen is to be left as it was found with all dishes, cutlery etc, cleaned and put away. The BBQ is to be cleaned.

Any damages, breakages or missing items must be reported to management.

Insurance

We strongly recommend you purchase travel insurance to cover the loss of monies paid in the event of having to cancel your reservation (Floods, COVID, Cancelled flights). See some of our favourite insurers below and ensure you have peace of mind on your trip;

This is general advice only and it is the guest responsibility to check the insurance details before purchasing. Beach Houses of Byron takes no responsibility for any insurance purchases or claims raised by guests. 

 

Cancellations

If you wish to cancel your booking or any additional services, you must contact Beach Houses of Byron by email at info@beachhousesofbyron.com.au or by phone on 02 6684 7471. We cannot guarantee that any changes can be made.

No refund will be granted where a booking is cancelled after 4pm 14 days prior to the arrival date.

No refund will be granted in the event a guest does not arrive for their booking or cancels on the date of their booking.

A cancellation confirmation email must be obtained. If a cancellation email is not received, the booking remains in effect.

Security Bond

A security bond of $1,000.00 will be held for our Luxury Beach Houses, a $500 bond for our Surf Shacks and $200 for Cove Studios.

(pre-authorization only). The security bond is in addition to the cost of the reservation.

Person(s) booking accommodation are responsible for any loss or damage to it.

Should there be any damage to the house, articles therein, missing items, or excess cleaning due to the house being left in an unacceptable state, these monies will be taken out of the security bond. If damages/extra cleaning costs exceed the bond held, we reserve the right to charge the credit card provided for the booking to recover any costs associated with the stay.

The bond is fully refundable after departure providing the property is left in a clean, tidy and undamaged condition.

The release of funds is pre-determined by the card issuing bank and can take anywhere from 7-14 business days. 

 

Noise & Party Policy

Excessive noise or any parties will not be tolerated; Beach Houses of Byron reserves the right to terminate the reservation immediately, without refund. 

Guests must not create noise which is offensive to neighbours especially between 10pm – 7am and during arrival/departure at any time throughout the occupancy. First noise complaints will result in the next day is eviction and cancellation of booking with no refund.

Offensive noise is prohibited and may result in:

  1. Termination of permission to occupy the property;
  2. eviction;
  3. loss of rental paid; and
  4. extra charges for security and expenses which may be deducted from the security bond.

Any amplified music players or Dj equipments spotted on site will result in instant evicted and booking cancellation with no refund.

Any illegal drugs spotted on site with result instant eviction and booking cancelled with our refund. 

Security Call Outs

The Holiday Letting Organisation Security call outs are charged at $165inc GST per call out. After a second complaint you may be evicted without refund.

Number of Guests

The number of guests must not exceed the amount stipulated in the itinerary or maximum allowed at the property. Breaches will result in bond deduction or eviction without refund.

Smoking

Smoking is not permitted within the house under any circumstances. Ashtrays are provided for those who wish to smoke outside. Any evidence of smoking in-doors will result in the full security bond being forfeited. Cigarette butts found in the garden will result in a deduction from the security pre payment for additional cleaning expenses.

 

Special Requests

Whilst we attempt to satisfy all special requests, we are unable to provide a guarantee.

 

Maps and Images

Map images, if shown, are for general information and may not necessarily reflect latest or actual services and geography.

 

No Tenancy

You agree that regardless of your length of stay there is no tenancy or other rights created under any Landlord and Tenant laws and there are no such laws that apply to your stay. The booking with Beach Houses of Byron is not a residential tenancy agreement under residential tenancy legislations. Failure to comply with any of the guest’s fundamental obligations and the terms and conditions of the property may result in immediate termination and eviction. The guest is granted a licence to occupy the accommodation for the agreed booking period. Refunds will not be paid on terminated occupancies.

 

Property Presentation

The description of the premises is given in good faith. From time to time, changes occur at properties, sometimes by owners and outside of Beach Houses of Byron control or knowledge therefore no responsibility for irregularities will be accepted.

 

Unplanned Outages

During periods of extreme weather events, power supply to properties can be interrupted due to unplanned outages. These power outages will also affect WiFi as the routers will be disabled.

These outages are out of the control of Beach Houses of Byron and no responsibility will be taken. We will however assist all guests during these periods to keep them up to date with the situation and instructions from the authorities, and to ensure their safety.

 

Personal And Lost Property

No responsibility will be taken by Beach Houses of Byron for guest’s personal property. If items are left at a property, Beach Houses of Byron will contact the cleaners to determine whether the items were located. If located, guests are required to send a postage paid, return addressed envelope to the office for the items to be returned. Return costs and tracking of items are the responsibility of the guest.

 

Animals & Pets

Pets are only permitted at pet-friendly properties if pre-arranged with and approved by Beach Houses of Byron in writing and is provided on a case-by-case basis.  Please note that pet-stay charges may apply – your reservations consultant will advise you at the time of booking. 

For all bookings where guests will be bringing a pet, we require a photo of the animal to verify the size. If this cannot be done we may refuse the booking or if they send the wrong information guests will be evicted and charged the full rate of their stay. When a booking is confirmed, all terms and conditions are considered agreed to by all parties staying at the property on the booking confirmation, including pet friendly terms and conditions.  

This includes excess cleaning charges or necessary deductions from your bond for damages caused due to any pet(s) agreed to on the booking.

Guests must ensure their pet: 

  •   Is groomed to avoid excessive moulting 
  •   Is cleaned prior to entering the house to avoid marks to the property
  •   Has had up to date worming, flea treatments, and vaccinations
  •   Has had nails trimmed to avoid scratches to the floors and furnishings
  •   Does not jump up on beds, furniture or rugs (indoors or outdoors)
  •   Is not left unattended as excessive barking may result in complaints from neighbours. If noise complaints are received and the pet cannot be quieted, guests will be required to remove the dog from the property at their own expense.

Additional cleaning charges may apply should pet hair, urine, fleas or any evidence (including smell) of the pet be left behind when guests leave. It is advised for pets to wear tick/flea collars to avoid bringing or picking up ticks/fleas to/from the area.

Beach Houses of Byron accepts no responsibility for death of, loss of, injury or sickness to pets during the accommodation period – full and sole responsibility for the pet and its actions lie with the pet owner and upon acceptance of terms and conditions the guest agree that no legal action (including payment of veterinary accounts) will be taken against the landlord and that no discussion will be entered into. Please be aware that some properties have not been designed to be pet friendly.

 

Changes Beyond Our Control

Compensation will not apply if a significant change is made for reasons beyond our control. These include war, threat of war, riots, civil disturbances, terrorist activity, industrial disputes, natural and nuclear disasters, fire, epidemics, health risks, changes due to rescheduling or cancellation of flights by an airline or alteration of the airline or aircraft type; closed or congested airports or ports, hurricanes and other actual or potential severe weather conditions, act of government or public authorities or other circumstances amounting to force majeure and/or Acts of God.

Competition Terms & Conditions

All competitions run on social media are subject to terms and conditions and may only be redeemed during certain dates. Contact the Beach Houses of Byron team for more information. These competitions are in no way sponsored, administered, or associated with Instagram or Meta. By entering, entrants confirm they are 18+ years of age, release Instagram, Facebook & Meta of responsibility, and agree to Instagram, Facebook & Meta’s terms of use. Prizes are not redeemable for cash.

 

Breach Of Terms And Conditions

You agree that, should you or your guests breach any of the terms and conditions:

You will pay to us the total loss or damage that we suffer as a result of that breach and hereby authorise us to debit your credit card or apply your refundable pre payment in payment of that loss or damage and we may evict you and your guests without notice

We always do our best to ensure your arrangements are satisfactory. Beach Houses of Byron management and employees shall not be liable for any injury, damage, loss, additional expenses, accident, delay, changes in accommodation, breakdown in equipment or vehicles, weather, strike, sickness, theft, cancellation or the foregoing shall likewise not be liable for any injury, damage, loss additional expenses, accident, delay or irregularity, whether to the property, person, or otherwise arising in connection with any accommodation or in connection with any vehicle or transport or other services.

 

Schoolies Terms & Conditions

 

Beach Houses of Byron Terms and Conditions apply; in addition, these conditions also apply.

At BHOB we are pleased to provide an environment for our youth to celebrate their end of school time. Clear guidelines are needed to make things run smoothly. We would like your holiday in Byron Bay to be an enjoyable experience for you and everyone else concerned.

By proceeding to make a booking you acknowledge that all members of your group have read and accepted the schoolies terms and conditions and will abide by them and one nominated group leader will be responsible for the reservation.

 

Payments and Cancellations

A non-refundable pre payment of 50% of the booking balance is to be paid at the time of the booking. The balance is due 60 days prior to arrival.

 

Security Bond

A security bond of $2,500.00-$5,000 per house is charged to the nominated credit card prior to arrival. The security bond is in addition to the cost of the reservation.

Should there be any damages to the house, articles therein, missing items, smoke residue, or excess cleaning due the house being left in an unacceptable state, these monies will be taken out of the security bond. Any damages in excess of the security bond will be deducted from the credit card provided for the booking.

The bond is fully refundable after departure providing the house is left in a clean, tidy and undamaged condition.

 

Keys

Two keys per house are issued, a replacement fee will apply if the key is lost.

 

Visitors

No visitors allowed. The beach house is for registered guests only. The SECURITY GUARD has the right to enter the property if necessary.

 

Noise & Party Policy

Excessive noise or any parties will not be tolerated; Beach Houses of Byron reserves the right to terminate the reservation immediately, without refund. Guests must not create noise which is offensive to neighbours especially between 10pm – 7am and during arrival/departure at any time throughout the occupancy.

Offensive noise is prohibited and may result in:

Termination of permission to occupy the property;
eviction;
loss of rental paid; and
extra charges for security and expenses which may be deducted from security bond.

Underage drinking and/or drug taking is illegal and will not be tolerated at any time.

Any amplified music players or Dj equipments spotted on site will result in instant evicted and booking cancellation with no refund.

Any illegal drugs spotted on site with result instant eviction and booking cancelled with our refund. 

 

Smoking & Rubbish

Absolutely no smoking inside the property. Charges for cleaning due to smoking in the property will be deducted from your bond.

Extra cleaning charges will be deducted from your security bond should any rubbish items, including cigarette butts, cans, bottles, etc. are left on the ground or in gardens.

 

Security

A security guard will be observing your accommodation during your stay. This is not just to keep an eye on noise levels, but for your security and we encourage you to speak to the guard if you feel it necessary.

If the security guard reports to Beach Houses of Byron intolerable behaviour from any member of your group, this may result in eviction without refund.

Breaches of these conditions may result in the forfeiture of your security bond, refusal of key and/or eviction at the discretion of the management. if you are evicted prior to your departure date the balance of your accommodation is not subject to refund.

All guest details are kept private and confidential.

We always do our best to ensure your arrangements are satisfactory. Beach Houses of Byron management and employees shall not be liable for any injury, damage, loss, additional expenses, accident, delay, changes in accommodation, breakdown in equipment or vehicles, weather, strike, sickness, theft, cancellation or the foregoing shall likewise not be liable for any injury, damage, loss additional expenses, accident, delay or irregularity, whether to the property, person, or otherwise arising in connection with any accommodation or in connection with any vehicle or transport or other services.

Covid Policy

 

Our cancellation policy is continually being reviewed to ensure that we are taking into account the developments associated with COVID-19.

If government COVID-19 lockdown come into place for the time of your stay you can either receive a refund less 10% of the total booking (minimum fee $150). 

 
Please note, any additional costs associated with disinfecting or replacing linen will be incurred by the guests and are not the responsibility of Beach Houses of Byron.

Your cancellation request under this policy must relate to Covid-19 and must provide;

a.       Driver’s licence with residential address and a reference document with the government public authority direction confirming your claim and cancellation request.

Beach Houses of Byron reserves the right to assess and determine a request for cancellation and/or refund.
